Crisis Medicaid Planning in Rhode Island

The practice of Rhode Island or RI elder laws often encompasses “crisis planning.” Seniors who face chronic medical problems, like most of us, often fail to plan. They fail to spend the time, energy and money to engage in estate planning.  More specifically, when seniors face challenges to their health, especially challenges likely to require nursing home care, their estate planning should address the possibility that medical expenses will become exorbitant.  This type of estate planning is often referred to as Medicaid planning, long term care planning or asset protection planning.  Failure to plan means that events that should have been foreseen, often lead to a crisis.

The typical crisis is one where the senior has been managing at home with various levels of assistance. But suddenly there is a fall, a stroke, an infection or some other event that necessitates admission to a nursing home.  After a period of evaluation it becomes clear that care at home is no longer possible.  Medicare provides a short period of coverage and a short period of time to figure out what to do. But the result for most of us is a true personal, emotional, and financial crisis. We are no longer able to keep our loved one at home and prevent the dreaded nursing home placement. In addition we are facing an enormous bill of $8,000 to $10,000 per month.  Our healthcare system is so difficult to navigate, that without help, seniors may be advised to spend all of their life’s savings before finding appropriate help.
